1. Warranty for Implants
Duration: Lifetime warranty.
Coverage:
- DESS undertakes to replace dental implants in the event of a manufacturing defect or clinical failure, provided that the indications for use and good clinical practice have been followed.
- In the case of an implant failure after osseointegration, DESS will cover the implant replacement at no additional cost.
- DESS will replace implants of other brands used in combination with DESS abutments, even if the failure is not covered by the original implant manufacturer.
Limitations:
- Costs associated with clinical or laboratory treatment are not covered.
- Exclusions for failures resulting from medical conditions such as alcoholism, uncontrolled diabetes, smoking, osteoporosis, or corticosteroid treatment.
- Failures due to medical negligence or misuse of the products are not covered. - Implants for which the surgical procedure involved the use of tools not permitted by the protocol indicated in the instructions for use, or tools with excessive wear or beyond the number of uses indicated in the instructions for use, or tools that do not comply with the relevant permits and health certificates will not be covered.
- The aforementioned coverages will be rendered invalid in the event that any of the components used during the surgical or prosthetic procedure do not have the applicable health approvals and permits needed.
The aforementioned coverages will be rendered invalid if the prosthetic restoration has been carried out by a dental laboratory or workshop that does not have the required permits for such activity.
In the event that the item to be returned is out of stock, DESS reserves the right to replace it either with an equivalent product or to pay the cost of sale of said product.
2. Warranty for Attachments (Abutments and Prosthetic Components)
Duration: Lifetime warranty.
Coverage:
- DESS guarantees the free replacement of DESS-branded abutments and prosthetic components in the event of a material failure or manufacturing defect, provided they have been used in accordance with the indications for use and in combination with both DESS-branded and non-DESS-branded implants.
Limitations:
- The warranty does not cover customized or temporary prosthetic components.
- Temporary components are limited to a one (1) year warranty.
- The warranty is rendered void if non-compatible third-party components or products are used or if proper clinical guidelines are not followed.
- The warranty is rendered void if the implants used in combination with DESS attachments do not comply with the applicable legal and sanitary requirements.
3. Surgical Instruments and Drills
Duration:
- One (1) year for surgical instruments (screwdrivers, sinus elevators, and dilators).
- Ninety (90) days for surgical drills, which must be replaced after 20 osteotomies.
Coverage:
- DESS guarantees the free replacement of surgical tools if they show manufacturing defects or failures within the stipulated time limits.
Limitations:
- Normal wear and tear of surgical instruments is not covered.
- Improper use or lack of proper maintenance of the instruments will render the warranty void.
4. Disclaimers and Exclusions
- Excluded medical conditions: The warranty does not cover product failures in patients with uncontrolled medical conditions, such as diabetes, bruxism, alcoholism, smoking, or bone disease (osteoporosis).
- Failure due to accident or negligence: Any damage caused by accident, trauma, or misuse of the products is not covered.
- Late claims: Claims must be submitted within 30 days of discovering the fault. Products must be returned in a sterile condition for evaluation.
5. Complaints Procedure
- Claim: The clinician must file a claim within 30 days of discovering the fault, together with the necessary documentation (claim form, x-rays before and after treatment, and clinical report).
- Product return: Defective products must be returned to DESS properly sterilized and accompanied by the claim form and the required documentation.
- Product replacement: DESS undertakes to replace the defective product within a maximum of 45 working days after receiving the claim and failed products.
